What do you mean by walking a line? Also yes it is important to have evidence or else it seems like you are giving punishments just for the fun of it.
A lot of cases will not have 100% evidence. That is when our opinions and evaluations are what are used to determine if penalties are needed for x behavior
That is why it is important to take into consideration what the other player is saying. Your opinions and evaluations are more likely to be from a one sided view not seeing it from the point of view of the player in that position. For example, you are not communicating with your opponent because the opponent is being aggressive. A judge comes in the judge gives the player who is not communicating a warning. The judges says "you are getting a warning for not communicating in the duel." I see this as the judge seeing this from a one sided view. Do you really want to talk with a person who is being aggressive? It is uncomfortable and difficult to play the game like that.
