I'm afraid ruling wise your opponent was in the right. They never summoned Servant the first time around (more precisely Servant never left the pendulum zone before so comparing it with a summon being negated is double wrong here), so they could in fact activate it again, as the pendulum effect is not OPT.
Obviously calling you the N word and leaving isn't okay, but in terms of playing they were correct.
